We are not medical professionals, nor dieticians and nothing on this website should be misconstrued to mean otherwise.

There may be risks associated with participating in activities mentioned on our site and for people in poor health or with pre-existing physical or mental health conditions. Because these risks exist, you will not participate in any meal plans available from us.  if you are in poor health or have a pre-existing mental or physical condition. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such dietary activities. These risks may also exist for those who are currently in good health right now.

As with any exercise program you assume certain risks to your health and safety. Any form of exercise program can cause injuries, and our programs are no exception. It is possible that you may become injured doing the exercises in your program, especially if they are done with poor form. Although thorough instruction is included in the form for each exercise.

Be aware that our programs (like any other exercise program) do involve a risk of injury. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such exercise activities. These risks may also exist for those who are currently in good health right now.

We are not medical practitioners or dieticians. Our advice whether it be on our website, in our meal plans, exercise program's or via email coaching, none of it is meant as a substitute for medical advice. You must consult your doctor before beginning ANY meal plan or exercise program, no exceptions. You are using our plans, program's, workout and coaching at your own risk and we are not responsible for any injuries or health problems you may experience or even death as a result of using our programs.

It is to be made clear that we are not responsible for any injuries or health problems you may experience or even death as a result of using any of our products or services.

 

GENERALLY EXPECTED RESULTS

Although our products and services are intended to be fully implemented, sometimes they are not, which could result in a lack of progress/results for the user. If you implement the products and services from us correctly you should see amazing results, however it must be disclaimed that even when consumers implement any products or services in full from us it is still possible they will not get the results they may have expected and it is also possible they will not lose fat or gain muscle or achieve any positive results of any kind.

However, it must be disclaimed that these testimonials are not claimed to represent typical results with our meal plan and workout programs.  They are meant as a showcase of what the most motivated and dedicated people can achieve by following our personalized meal plan and workout programs. Your results may vary  and you may not get the same results compared to someone else when using our services due to differences in your individual exercise history, genetics, and personal motivation/dedication. The end results you get will depend upon the individual and how much effort you put in.

IMPORTANT RECURRING SUBSCRIPTION BILLING INFORMATION

If you purchase our Program you will be automatically charged every period and you will continue to receive new updated meal plans and workout programs  for the time that you choose to remain a client.  In order to cancel your subscription simply send an email to  seraphimfitness2020@gmail.com

This is a recurring subscription, however you are welcome to cancel at any time. Please note that due to the time invested in your initial set-up, you are not entitled to a refund at any point but if you do choose to cancel, your recurring payments will stop immediately. If you have purchased a program during a promotional period and have redeemed that promotion (e.g. supplements, clothing, headphones) you are not eligible for a refund.

IMPORTANT LEGAL DISCLAIMER

In consideration of being allowed to participate in any way in Seraphim Fitness LLC programming, or Physical Training related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1.     The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

2.     I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.     I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4.     I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Seraphim Fitness LLC their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

 

PHYSICIAN RELEASE AND MEDICAL LEGAL DISCLAIMER

Because physical exercise can be strenuous and subject to risk of serious injury, I am stating that I have already had a physical examination from a doctor and have been recently cleared to exercise before agreeing to begin exercising and using Seraphim Fitness LLC programming or suggestions using any exercise equipment or participating in any exercise activity. Any physical impairments that will increase risk to injury will be under your personal judgement and will not hold Seraphim Fitness LLC or anyone associated responsible for injuries or risks. You agree that by participating in physical exercise or training activities, you do so entirely at your own risk. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician or dietician prior to undergoing any dietary or food supplement changes. By agreeing, you acknowledge that use of and association with Seraphim Fitness LLC will not be held responsible for any issues in diet/nutrition as well as wellness/health or any body changes. You are agreeing you understand we are not dieticians or physicians. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property, personal injury, or personal well-being. You also agree that changes in your personal health are your responsibility and there is no “cure-all” that Seraphim Fitness LLC will be responsible for. You also understand that ideal body transformations are your own responsibility and Seraphim Fitness LLC will not be held responsible for any changes in body or mind that are undesired. 

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge the trainer or instructor and business from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may other- wise have to bring a legal action against the trainer or instructor or Seraphim Fitness LLC for personal injury, negligence, property damage, medical issues, etc.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.

I AGREE TO NOT HOLD SERAPHIM FITNESS LLC OR ANYONE ASSOCIATED RESPONSIBLE FOR ANYTHING.

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 

 

MINORS: FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)This is to certify that I, as parent/guardian with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of the activity and his/her responsibilities for adhering to the rules and regulations. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s/ward’s involvement or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. I AGREE TO NOT HOLD SERAPHIM FITNESS LLC OR ANYONE ASSOCIATED RESPONSIBLE FOR ANYTHING.

 

IN CONSIDERATION OF my child/ward being allowed to Name Of Minor Child/Ward participate in any way in the Seraphim Fitness LLC. related events and activities, the undersigned acknowledges, appreciates, and agrees that:

I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; and,

I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Seraphim Fitness LLC; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

I, the parent/guardian, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulation, and accept them as a participant.

In consideration of participation with Seraphim Fitness LLC, the undersigned agrees that their likeness, or the likeness of themselves may be photographed or videotaped and that such image may be published in an outlet used to promote or publicize the sports program if given to Seraphim Fitness to use.
